The Legal Affairs Commission took a position on two key issues at its meeting on May 23, 2025.
The commission has completed its work on a preliminary draft for the implementation of parliamentary initiative Kamerzin 21.449, "Promoting shared custody in cases of joint parental responsibility." The preliminary draft aims to promote equal participation of both parents in childcare when, following a separation or divorce, the parents share custody and are unable to agree on a custody arrangement. The commission is presenting two implementation options for discussion. The consultation process will open before the summer recess.
Despite the dissenting vote of its counterpart committee in the Council of States, the commission is maintaining its original position and has unanimously decided to support parliamentary initiative Nantermod 24.419 , "Children of unmarried parents. For joint parental custody from birth." The commission wants parents to have equal rights, regardless of whether they are married or not. The initiative now goes to the National Council, which will decide whether to support it.
