At its meeting of May 23, 2025, the legal commission commented on two essential topics.

Strengthening alternating care

The Commission has completed its work on a preliminary draft to implement the Parliamentary Initiative Camerotine 21,449 , "promoting alternating care with a joint parental concern". The preliminary draft pursues the goal of promoting even participation in both parents in childcare if the parents exercise their parental concern together after a separation or divorce and they fail to agree on a childcare model. In addition, the Commission provides two variants of implementation. The consultation for this is opened before the summer break.

Common parental care from the birth for children of unmarried parents

Despite the deviating vote of its Sister Commission, the Commission adheres to its original position and has unanimously decided, the parliamentary initiative Nantermod 24.419 , «children of unmarried parents. For a common parental concern from the birth », to follow. The Commission wants parents to have the same rights, regardless of whether they are married or not. The initiative is now going to the National Council, which has to decide whether to follow the initiative.
